The Wire Act
The most significant of these shifts came with the 2011 US Department of Justice (DOJ) opinion on the 1961 Wire Act. Under the original language of the Wire Act, any gambling-related transaction using a 'wire communication' was illegal.
With this language in place, online casino gambling was explicitly illegal on a federal level. In 2011, the DOJ issued an opinion that the Wire Act only applied to sports betting transactions that crossed state lines.
The new DOJ opinion opened the possibility for individual states to legalize online gambling, within state borders, if they chose to do so.
